Terms of Use

These terms govern your use of PlexusMD Viewer — the apps for iPhone, iPad and Android and the web viewer at viewer.plexusmd.org — provided by Dermatological Beauty LLC ("we"). The viewer itself is free; optional research models that run on our servers are paid per use, as described in section 6 and on the Pricing page. By using PlexusMD Viewer you accept these terms.

1. The service

PlexusMD Viewer opens and displays medical images in DICOM format, offers measurements and reconstructions, keeps studies in a library on your device, lets you share anonymised studies by time-limited link, and on the web viewer offers published research models, some of which run on our servers on anonymised images you choose to send.

2. Not a medical device; not for diagnosis

PlexusMD Viewer is a viewing and reference tool. It is not a medical device and is not intended for diagnosis, treatment or any clinical decision.

Clinical decisions must be based on the original images in authorised systems (such as a PACS) and on official reports. Measurements, reconstructions, automatic measurements and segmentation are estimates and must be verified by a qualified professional. Display quality depends on your device and may differ from diagnostic monitors.

Research models (for example breast density or stroke lesion segmentation) are published tools of other authors, offered for research use under their own licences, which are named in the viewer. Their outputs are research measurements: they are not validated for clinical use here and must be checked and corrected by a qualified professional.

3. Who may use it

PlexusMD Viewer is intended for healthcare professionals, students in the health professions, researchers and patients viewing their own images. You must be old enough to accept these terms where you live.

4. Your responsibilities

• You must have the right to open, keep and share the images you use, and follow the patient privacy laws and institutional rules that apply to you (for example HIPAA, the GDPR or Turkey's KVKK).
• Share studies only for legitimate professional purposes and only with people who should see them.
• Identity fields in the DICOM tags are removed before sharing, but information drawn into the pixels is not: checking for it is your responsibility.
• Do not include patient details in messages to us.
• Keep your device secure; studies in the library are available to anyone who can unlock it.

5. Acceptable use

You agree not to misuse the service: not to attempt to access other people's shares without their link, disrupt or overload the service, work around its limits, upload anything unlawful or anything that is not medical imaging, or use it to send unsolicited messages.

6. Share links, research models and limits

Share links work for at most 120 minutes and can be removed by the sender at any time. To keep the service available, sharing and emailing are limited per network address and in total; the limits may change. Shared studies are deleted when the link ends, and we keep no copy.

Research models that run on our servers need an account or an access code and accept only anonymised studies. You must not send images you are not allowed to process outside your institution. The images sent are deleted after use, as described in the Privacy Policy.

Prepaid usage and prices. Models we may offer commercially are paid per run from prepaid usage, priced in US dollars, at the prices on the Pricing page and shown before each run. When a run starts its estimate is set aside; when it ends, what it cost is used and the rest stays available; a run that fails costs nothing. Prepaid usage can be used only for runs in PlexusMD Viewer; it is not money, has no cash value, cannot be transferred, exchanged or used anywhere else, and earns no interest. Prices may change; a change never applies to a run already started.

Research support. Models licensed for research use only are never sold. They run on research support, which we may grant on request, at our discretion, for a study; it has no cash value, cannot be bought, transferred or refunded, and may be withdrawn if it is misused.

Payments and refunds. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and provides all customer service inquiries and handles returns. A purchase of prepaid usage none of which has been used can be refunded within 14 days of the purchase; write to viewer@plexusmd.org or ask Paddle. Usage that has been used, welcome usage, gifts and research support are not refundable. Accounts that misuse the service may be closed.

7. Intellectual property

PlexusMD Viewer, its design and its code belong to Dermatological Beauty LLC. We grant you a personal, non-exclusive, non-transferable licence to use the app and the web viewer under these terms. Parts of the app use open-source software under their own licences, listed in the app's settings. The images you open remain yours or your institution's; we claim no rights in them.

8. Availability and changes

The service is provided free of charge. We may change, suspend or discontinue features, and we may update these terms; the date at the top shows the latest version, and continued use after a change means you accept it.

9. Disclaimer

PlexusMD Viewer is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Dermatological Beauty LLC is not liable for any indirect, incidental, special or consequential damages, or for any loss of data or harm arising from the use of, or decisions based on, images, measurements or other output shown in PlexusMD Viewer. Nothing in these terms limits liability that cannot be limited by law.

11. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules, except where the law of your country of residence gives you mandatory protections.
